Terms of Use

1. Acceptance of terms

By downloading, installing, or using Spendaq ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and the Spendaq developer. We reserve the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years old to use Spendaq. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf. Spendaq is available on iOS 17 and later.

3. License

Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Spendaq on Apple devices you own or control, solely for your personal, non-commercial use.

You may not copy, modify, or distribute the App; reverse engineer or decompile it; use it for commercial purposes without written consent; attempt to circumvent any subscription or feature limitation; or use the App in any way that violates applicable law.

4. Subscriptions and in-app purchases

4.1 Subscription plans

Prices are listed in USD and may vary by region as determined by Apple's regional pricing. All prices include applicable taxes where required by law.

4.2 Free trial

Pro Monthly and Pro Annual plans include a 3-day free trial for new subscribers. The trial converts to a paid subscription at the end of the trial period unless cancelled beforehand. Any unused portion of a free trial is forfeited if you purchase a subscription before the trial ends.

4.3 Billing and renewal

Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

4.4 Managing and cancelling subscriptions

Manage or cancel your subscription at any time: iPhone Settings → [Your Name] → Subscriptions, or via the App Store on any of your Apple devices. Cancelling stops future renewals but does not refund the current billing period. You retain Pro access until the end of the paid period.

4.5 Lifetime purchase

The Lifetime plan is a one-time non-consumable in-app purchase granting permanent access to all Pro features available at the time of purchase and all future Pro features. Lifetime access is tied to your Apple ID and is not transferable.

4.6 Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple's refund process at reportaproblem.apple.com. We do not process refunds directly.

4.7 Free tier

The free tier allows up to 8 total transactions and includes core features as described in the App Store listing. We reserve the right to adjust free tier limits in future versions.

5. Your data

All financial data you enter into Spendaq (transactions, budgets, categories, notes) is stored locally on your device and, if you enable iCloud sync, in your personal Apple iCloud account. We do not store or access your financial data on our servers.

You own your data. You can export it at any time using the CSV or PDF export feature (Pro only). You can delete it at any time using the Clear Data option in Settings. You are responsible for maintaining backups. We are not liable for data loss resulting from device failure, accidental deletion, or iCloud service issues.

6. Acceptable use

You agree to use Spendaq only for lawful personal financial tracking. You may not use the App to track financial activities related to illegal conduct, circumvent the App's security features, attempt to access another user's data, or use automated means to interact with the App.

7. Partner vault sharing

Pro users may share a vault with one other Spendaq user via Apple's iCloud CloudKit. By sharing a vault, you agree to share the transaction and budget data within that vault with your designated partner. You are responsible for inviting the correct person. Either party may leave a shared vault at any time from within the App settings.

8. Currency data

Exchange rates used for multi-currency conversions are fetched from a third-party exchange rate API and provided for informational purposes only. They may not reflect real-time market rates. Spendaq is not liable for financial decisions made based on these rates.

9. Third-party services

Spendaq integrates with Apple App Store / iCloud / CloudKit (Apple Terms of Service) and RevenueCat for subscription management (RevenueCat Terms), each subject to their own terms.

10. Intellectual property

Spendaq, its logo, design, code, and content are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission. The Spendaq name and tagline are proprietary.

11. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted or error-free, or that exchange rates, calculations, or data presented in the App are accurate.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR FINANCIAL LOSS. Our total liability to you shall not exceed the amount you paid for the App in the 12 months preceding the claim.

13. App Store additional terms

Your use of Spendaq is also subject to Apple's Media Services Terms and Conditions. Apple is not responsible for Spendaq or its content. Apple has no obligation to provide maintenance or support for Spendaq. Apple is a third-party beneficiary of these Terms and may enforce them against you.

14. Governing law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be resolved through good-faith negotiation, and if negotiation fails, through binding arbitration.
